These Terms and Conditions apply to all sales and supply of Products by Bed Bugs Limited to the Customer via BedBugMonitor.com.

1. General Provisions

• Statutory Rights: Your statutory customer rights are not affected in any way by these Terms and Conditions of Sale.
• Governing Law: These terms and conditions are governed by and shall be interpreted in accordance with the laws of England and Wales.
• Agreement: By making a purchase from Bed Bugs Limited, you are agreeing to these Terms and Conditions of Sale.
• Definitions:
  • Bed Bugs Limited: Means Bed Bugs Limited of 12 Hermitage Lane, London SE25 5HH.
  • Customer or “you”: Means the person or company who has placed an order with Bed Bugs Limited for the purchase of any of the Products.
  • Products: Means the products and services offered for sale by Bed Bugs Limited.

2. Product Information and Responsibility

• Pesticide Compliance: To comply with UK Government legislation, all pesticide products must be supplied in their original packaging, which includes the registered label text for safe handling and use.
• Customer Responsibility: It is the customer’s responsibility to read and comply with the label instructions for all Products.
• Warranties: All product warranties are the responsibility of the product manufacturer.
• Third-Party Statements: Bed Bugs Limited sources products in good faith from reputable suppliers. Like any retailer, we cannot be held legally responsible for product statements made by these suppliers in their promotional material or on product labels.
• Product Appearance: Products supplied may be different from those displayed on the website.

3. Prices and Payment

• Currency and VAT: All our prices for Products are quoted in Sterling (£) and are inclusive of VAT.
• Exclusions: Prices are exclusive of carriage and packing (shipping) charges, as this cost can vary.
• Total Cost: Unless otherwise stated, carriage is added to your order prior to purchase, and the total price will be clearly displayed to you before you complete your transaction.
• Delivery Method: Bed Bugs Limited reserves the right to decide if products are supplied by courier or through the postal system. There are no other additional costs.
• Price Validity: Prices at the point of purchase remain valid until delivery is accepted.
• Payment Method: Payments must be made in £ Sterling, unless otherwise specified, using any of the payment methods displayed at checkout. All payments for product purchases are completed via our secure server.

4. Delivery

• Delivery Dates: Any date or period stated for delivery shall be considered as indicative only.
• Shipping Aim: If a Product is in stock, we aim to ship it to you within 48 hours of placing the order.
• Delayed Dispatch: If we cannot dispatch an item to you within 10 days of your order, we will notify you by e-mail. At your request, we will cancel the order and either refund your money in full or supply a comparable alternative product.
• Third-Party Delays: Bed Bugs Limited cannot be held responsible for delays in the delivery caused by the product manufacturer or any other third party.

5. Acceptance and Inspection of Goods

• Customer Inspection: The Customer shall be responsible for inspecting all goods on arrival.
• Courier Delivery: Where a courier is used, goods must be inspected prior to signing the carrier’s note.
  • If goods are damaged, this must be explicitly stated on the carrier’s note. Without this written statement, no claim will be considered by the carrier.
• Postal Delivery: The Customer is responsible for inspecting goods supplied through the post.
• Notification of Damage: Bed Bugs Limited must be notified of damaged products in writing within 3 days of receipt of goods. This does not affect your statutory rights.
• Defective/Incorrect Products: If any Products supplied are considered defective or different from the product ordered, an immediate full refund will be provided upon return of the Products to Bed Bugs Limited at 12 Hermitage Lane, London SE25 5HH.
• Non-Defective Returns:
  • Goods exchanged or replaced for reasons other than being defective or incorrect will be subject to our postage and packing charges for new orders.
  • We will not accept responsibility for postal charges or lost items when returning non-defective goods.
  • All non-defective goods returned must be in stock condition and in the original packaging.

6. Cancellation Policy

• Right to Refuse/Evaluate Orders: Bed Bugs Limited reserves the right to refuse any order or part order or to request further information to enable it to process or evaluate the order.
• Failure to Ship: Bed Bugs Limited accepts no liability for any failure to ship products where this results from its inability to do so or its decision, on reasonable grounds, not to do so, provided it notifies the customer within 10 days of order placement. In such cases, Bed Bugs Limited will immediately refund any payments made in full.
• Customer Cancellation: The customer has the right to cancel their order within 7 working days of receipt of the goods.
  • The customer is responsible for any costs involved in returning the goods.
  • Once Bed Bugs Limited has verified that the returned product is in stock condition and in the original packaging, the customer’s money will be refunded within a reasonable period.
